Waiver and Release of Liability

I, {name}, the undersigned participant, hereby acknowledge and agree to the terms and conditions set forth in this Waiver and Release of Liability ("Agreement") in consideration for being permitted to participate in activities, training, classes, events, and use of facilities provided by Doggpound MMA ("Organization"). I further agree and warrant that is any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.

ASSUMPTION OF RISK:

I understand that participating in martial arts and fitness activities involves inherent risks, including but not limited to bodily injury, strain, sprain, fracture, concussion, paralysis, or even death. I acknowledge that these risks cannot be entirely eliminated even with proper training, supervision, and equipment.

RELEASE OF LIABILITY:
 
(a) I acknowledge that participation in martial arts instructional classes and activities involves intense, stressful and strenuous exercise and physical contact, which carry with them a high degree of risk and can result in serious physical or emotional injury, including, but not limited to, paralysis, death, bruises, bloody noses, unconsciousness, soft tissue damage, broken bones, heart attacks and other cardiovascular injury, and other serious damage to person or property. I further acknowledge that such risks cannot be eliminated without jeopardising the essential qualities of the activity.
 
(b) I confirm that I have been made aware of the above risks as well as other risks associated with participating in martial arts instruction and the martial arts, and that member is hereby assuming such risks voluntarily.
 
(c) I hereby release and agree to indemnify and hold the school and its officers, directors, managers, members, partners, employees and agents and their respective affiliates harmless from any and all claims and liabilities of any kind or nature arising out of, or related to, member’s participation in the school’s classes and curriculum and the martial arts, including, but not limited to, any claims based on the school’s negligence.
 
(d) I certify that I have, and at all times during the term will have, adequate insurance to cover any injury or damage suffered as a result of attending school classes or participating in the martial arts. alternatively, I certify that I have, and during the term will continue to have, the means to self insure against such injury or damage. I further certify that I have no medical condition which could interfere with the Member’s safe participation in school classes or the martial arts.
 

INDEMNIFICATION:

I agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all liabilities, costs, expenses, claims, demands, causes of action, or judgments arising out of my participation in activities provided by Doggpound MMA, including but not limited to medical expenses, legal fees, and court costs. 

MEDICAL TREATMENT:

I authorize the Organization's staff to seek emergency medical treatment for me in the event of an injury, accident, or illness during my participation in any activities organized by Doggpound MMA. I understand that the Organization will take reasonable steps to notify my emergency contact, but I also acknowledge that they may need to make medical decisions on my behalf.

USE OF LIKENESS

I grant the Organization the right to use my likeness, name, and voice in photographs, video recordings, and other media for promotional purposes without compensation.

SEVERABILITY:
In the event that any provision of this Agreement or the application thereof, becomes or is declared to be illegal, void or unenforceable, the remainder of this Agreement will continue in full force and effect. The parties further agree to replace such void or unenforceable provision with a valid and enforceable provision that will achieve, to the extent possible, the economic, business and other purposes of such void or unenforceable provision.
 

Acknowledgement: I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I AM AWARE THAT BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES. I AM SIGNING THIS AGREEMENT VOLUNTARILY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE.
